Vadistanbul Avm Hizmetleri Anonim Şirketi (hereinafter ‘Vadistanbul’ or the ‘Company’) makes best efforts in order to ensure protection of personal data of all real persons with whom the Company contacts in any manner and to fulfil all requirements of the Personal Data Protection Law no. 6698 (hereinafter ‘PDPL’ or the ‘Law’) while performing its commercial activities ever since the Law entered into force.
This Personal Data Protection and Non-Disclosure Policy (the ‘Policy’) is issued to provide information about the processes and principles governing the collection, utilization, disclosure, transfer and storage of personal data by Vadistanbul. This Policy elaborates the principles adopted by Vadistanbul for processing personal data of data subjects in line with the provisions of the PDPL. Explicit consent of data subjects is one of the legal prerequisites in order to process personal data in a legitimate manner. Where explicit consent is not provided, personal data may be processed in case of availability of the following conditions provided in the Law. Hence, Vadistanbul may undertake personal data processing activities to the extent that:
Conditions for Processing Special Categories of Personal Data
Vadistanbul takes utmost care in processing special categories of personal data since they are of critical importance for protection of data subjects. Accordingly, in the absence of explicit consent of a respective data subject, Vadistanbul may only process: (i) special categories of personal data other than health condition and sexual life of the data subject under the conditions specified in the laws, (ii) special categories of personal data related to the health condition and sexual life of the data subject only by means of persons who are under non-disclosure obligation or competent authorities and institutions for the purpose of protecting public health, applying preventive medicine, performing medical diagnosis, treatment and care services, and planning and administering healthcare services and funding provided that the adequate precautions to be designated by the Board shall be duly adopted in both cases.
Vadistanbul shall process personal data based on the following purposes which may be updated from time to time in line with the corporate policies and legal obligations:
The aforementioned categories are provided for informational purposes in that Vadistanbul reserves the right to introduce other categories in order to facilitate its commercial and other relevant operations in the future. In such cases, Vadistanbul shall update the relevant categories in this text as necessary in order to continue providing information to you as promptly as possible.
Vadistanbul stores the personal data safely in physical or electronic media for a suitable period in order to perform its commercial operations. In that respect, Vadistanbul complies with all of the obligations indicated in the applicable regulations including the PDPL with respect to protection of personal data. Pursuant to the relevant regulations, Vadistanbul shall delete, remove or anonymize the personal data either on its own or upon the request of data subjects by means the application form or otherwise as soon as the relevant processing purposes are duly fulfilled without prejudice to conditions allowing or requiring longer retention of personal data. If the personal data are deleted with the use of the relevant methods, these data shall be destroyed in a manner to render them unusable and irrecoverable in any manner.
Nevertheless, where required for protecting the legitimate interests of the data controller, personal data may be stored until the conclusion of the general prescription period provided in the Obligations Code (ten years) notwithstanding the expiration of the period specified in the applicable laws and conclusion of the processing purpose provided that the fundamental rights and freedoms of data subjects shall not be impaired. After the relevant prescription period, personal data shall be deleted, removed or anonymized according to the procedure indicated above.
Vadistanbul diligently observes the conditions of the PDPL in addition to the provisions of other applicable laws in relation to disclosure of personal data to third parties. In that respect, Vadistanbul does not transfer personal data to third persons without explicit consent of the data subject. Still, pursuant to the provisions of the PDPL, Vadistanbul may transfer personal data without explicit consent of the data subject to the extent that:
It shall be possible to transfer special categories of personal data other than health conditions and sexual life if provided in the applicable laws while special categories of personal data related to health conditions and sexual life can be transferred for the purpose of (a) Protection of public health, (b) Preventive medicine, (c) Medical diagnosis, (d) Treatment and medical care services, (e) Planning and management of healthcare services and funding etc. without obtaining explicit consent by taking adequate precautions.
The conditions provided for processing of special categories of personal data shall also be applicable for the transfer of any such data.
Data subjects are required to provide explicit consent for transfer of personal data abroad in line with article 9 of the PDPL. Nevertheless, Vadistanbul may transfer personal data, including special categories of personal data, abroad without obtaining explicit consent from data subjects in case of conditions allowing for processing of personal data without such explicit consent provided that the foreign country where the personal data shall be exported should have sufficient measures for protection of personal data. If the country where the personal data are to be exported is not deemed to be among the countries with sufficient protection by the Board, Vadistanbul and the data controller/data processor in the relevant country shall undertake to ensure sufficient protection in writing.
Vadistanbul shall ensure that data subjects shall be able to exercise the rights indicated in article 11 of the PDPL with respect to the personal data processed in line with the principles specified herein. In that respect, data subjects shall be entitled to:
Data subjects may exercise the abovementioned rights by submitting a copy of the duly signed application form attached to this Policy to the contact addresses of Vadistanbul by mail, e-mail or registered letter. The application form contains information about completion and submission of the form to Vadistanbul. Upon receiving any such form, Vadistanbul shall convey its response to the data subject filing the application physically or in electronic media.
Vadistanbul shall conclude the requests of data subjects free of charge as soon as possible not to be later than thirty (30) days according to the attributes of the request. Still, if any such request requires an additional cost, Vadistanbul shall charge the relevant cost to the relevant person based on the tariff specified by the PDPL Board. Besides, Vadistanbul may demand data subjects to submit additional information or documentation for concluding relevant responses.
Vadistanbul is dedicated to taking all kinds of technical and administrative measures required for ensuring suitable security level for protecting personal data. Vadistanbul shall take the following measures in order to (a) prevent unlawful processing of personal data, (b) prevent unlawful access to personal data, and (c) ensure safekeeping of personal data:
Vadistanbul records CCTV footage of the visitors, employees and other relevant persons in line with the fundamental principles of the PDPL and this Policy in order to promote the commercial and overall security of the facilities and enterprises. Vadistanbul keeps the CCTV footage safely in physical or electronic media throughout the period specified for the processing purposes.
Notices are visibly displayed where CCTV footage is taken in order to duly inform the data subjects. In that regard, Vadistanbul shall comply with all kinds of legal requirements, including specifically PDPL, with respect to protection of personal data. CCTV system shall not be available in areas requiring high degree of privacy.
This Policy shall become effective on the date of publication. Vadistanbul shall have discretion to make amendments to this Policy, including abolition of the Policy, and determine principles of implementation.
Rules of implementation shall be determined by means of a regulation to be issued under this Policy in order to elaborate the implementation of the matters provided herein for specific conditions.
